Court Announced 2 Years Jail To Rahul, What Next?

Congress MP Rahul Gandhi is targeting Prime Minister Narendra Modi and Bharatiya Janata Party aggressively. Earlier Rahul Gandhi faced criticism that he is not aggressive enough in targeting Modi. He is addressing this by not leaving any stone unturned to target the ruling party. Not just in India, he is using every platform to target the BJP.

 Recently we have seen how his comments on Modi and BJP in London created a big political storm in the country. The Bharatiya Janata Party lashed out at the former chief of Congress and said that he brought shame to the country and he should apologize for this.

Amid this, the Wayanad MP faced a big blow with a local court convicting him to two years of jail term. In an old issue, the court held him guilty in a defamation case for making objectionable comments about Prime Minister Narendra Modi.

Ahead of the 2019 Lok Sabha polls, Rahul Gandhi took a dig at Narendra Modi and asked how every thief has the Modi surname in common. A BJP leader took a strong objection to this and filed a case. The case has been going on and a local court held Rahul guilty and slapped him with two years sentence. Having said that the court gave him one month time for him to appeal the verdict in the higher court.

Now all eyes are on Rahul Gandhi to see what he will do. If he appeals the case and gets relief then it is ok. If the Higher court supports the verdict given by the local court, then he will be in danger of getting disqualified as per the rules.

The Representation of the People Act, 1951 says that a legislator would be disqualified if he or she is sentenced to imprisonment for two years or more. However, the sitting legislators can appeal the verdict.

Sometimes the Courts consider the situation in which the accused made the comment, and if it feels that the comment was made in the heat of a moment the verdict would be turned down. The Congress leaders are hoping for the same.
